On Monday, Johnson & Johnson (NYSE:JNJ) announced a sweeping agreement to settle its outstanding talc-related lawsuits.
The proposed resolution, coordinated with lead plaintiff firms in federal Multi-District Litigation (MDL) and state courts, requires a 95% participation rate among remaining claimants to move forward.
Lack Of Scientific Merit Leads To Favorable Ruling
The settlement arrives on the heels of a favorable court decision highlighting the plaintiffs’ inability to demonstrate specific causation connecting the company’s talc products to individual cases of ovarian cancer.
The company has successfully defended itself in the vast majority of ovarian trials to date.
On July 22, 2026, the MDL court demanded plaintiffs justify why pending claims should not be dismissed outright.
This occurred after plaintiffs pulled their expert witnesses in two key bellwether cases when a hearing revealed their scientific methodologies were unreliable.
The healthcare giant maintains its long-held stance that cosmetic talc is safe, asbestos-free, and backed by decades of independent medical research.
Financial Impact And Finality
To bring a close to this 15-year legal battle, Johnson & Johnson has committed $5.5 billion to resolve the claims. The initial payment, capped at $3 billion, is scheduled for 2027, with no further payouts required until 2028.
This agreement builds on earlier progress, including the resolution of roughly 95% of filed mesothelioma lawsuits, state consumer protection disputes, and supplier issues.
Prior to spinning off its consumer health division, Kenvue Inc. (NYSE:KVUE), in August 2023, the company agreed to retain all talc liabilities and indemnify the newly formed entity against related costs.
Furthermore, the global sale of talc-based baby powder was officially discontinued in 2023 as part of a worldwide portfolio evaluation.
JNJ Price Action: Johnson & Johnson shares were up 2.69% at $270.05 at the time of publication on Tuesday. The stock is trading at a new 52-week high, according to Benzinga Pro data.
